Herons Glen HOA received three candidates to fill two positions on the HOA Board. The election ballot package was mailed out on November 1st to the address of record for each Lot. If you have your mail forwarded, please allow extra time to receive it. For mailing address questions please send an email to lori.hghoa@gmail.com.

Once you have your ballot package, please read the instructions carefully. To return the ballot it must be inside the ballot envelope provided and placed inside the voter’s certificate envelope, then sign the voter’s certificate on the back, seal, and return by close of business on December 12, 2023. The signed Voter certificate envelope containing the sealed ballot envelope and ballot may be mailed to the HOA office or dropped in the ballot box outside of the HOA Office.

The two candidates receiving the highest number of votes will be announced at the Annual Membership Meeting to be held at 4:30 p.m. on December 13, 2023, in the Herons Glen Ballroom.

Annual Membership Meeting

The Heron Glen Homeowners Association Annual Membership Meeting will be held on December 13, 2023, at 4:30 p.m., in the Herons Glen Ballroom.

October 2023 Report

The ARC received 28 applications for the month of October.

The ARC Chair Andrew Cohen and Co-Chair Bob Stewart met with the Communications Committee and provided information about the ARC Procedures and requirements. Suggestions were made to for a draft flow chart and will be submitted to the ARC Committee to review.

The committee voted to forward to the board a draft of proposed changes to ARC Construction Standards for consideration of composite roof tiles.

The next scheduled meeting is November 14, 2023, at 9:00 am in the HOA Conference Room/Zoom.

Heron’s Glen HOA Activities Committee Monthly Report Meeting of October 26, 2023

The HOA Activities Committee met on Thursday, October 26th, at 10:00 AM. Meeting called to order by HOA Board Liaison Denise Fell at 10:00 AM. In attendance: Bernadette Schirra, Debbie DeFazio, Donna Piascik, Shirley Hrabar, Sue McCoy, Suzanne Offutt, Joyce Lipkin. Janet Stewart Norris had an excused absence.

Committee Business discussed:

1. No Volunteers came forward for the Chairman position. Committee nomination and vote for Secretary. Bernadette Schirra was nominated and approved. Committee nomination and vote for Treasurer. Sue McCoy was nominated and approved.

New Business:

1. Christmas decorating at entrance to Herons Glen will be done November 20th at 9AM.
2. Christmas Cart Parade – Sunday, December 3, 2024.
3. Activities Fair – Sunday, January 21, 2024.
4. Technology Class – Date TBD. Trying to schedule it in January.
5. Shredding Event – Date to be coordinated with Firewise event in February.
6. Ice Cream Social – Sunday, April 14, 2024.
Next meeting to be held on Thursday November 16, 2023, at 10:00 AM in the HOA Conference room.

Five Safety Tips for Deep Frying Turkey

With Thanksgiving right around the corner some of you may be thinking about deep frying a turkey for the first time.

When it comes to deep frying turkey, you want to take every precaution to keep your family and your home safe.

Fried turkeys are delicious, but they come with a slew of safety issues. Thousands of fires as well as many deaths and injuries happen each year due to turkey fryer fires. Before you set up your turkey fryer this Thanksgiving, remember these safety tips.

Get the Tips

1. Stay Away from The House – Set up the turkey fryer more than 10 feet away from your home and keep children and pets away. Never leave it unattended.

2. Find Flat Ground – The oil must be even and steady at all times to ensure safety. Place the fryer on a flat, level surface and carefully gauge the amount of oil needed.

3. Use a Thawed and Dry Turkey – Make sure your Thanksgiving turkey is completely thawed and dry. Extra water will cause the oil to bubble furiously and spill over. If oil spills from the fryer onto the burner, it can cause a fire.

4. Monitor the Temp – Use caution when touching the turkey fryer. The lid and handle can become very hot and could cause burns. Also be sure to keep track of the oil’s temperature as many fryers do not have their own thermostats.

5. Be Prepared – Have a fire extinguisher (multipurpose, dry-powder) ready at all times in the event that the oil ignites.

Recently, there have been rumors of break-ins in the community. Only one incident has been reported to the HOA Office and the Sheriff's dept. The incident is believed to have occurred on October 12th when a couple left their home and upon return, that day found their garage door was open. On October 19th, they realized some jewelry was missing and believed the theft may have occurred on October 12th.

Yesterday the HOA Office was informed that another garage door had also been found open on October 12th just four doors down from the other home on Via Athena. The homeowner's neighbor knew the owner was out of town and shut the garage door and contacted the owner. When the homeowner returned, they checked the home and did not find anything missing.

A concern has been raised that perhaps someone can hack certain garage door remote control operators and open the garage door. We do not know if this is the case with either of the garage doors open on 10/12.

If you have concerns about the security of your garage door remote system, please contact your garage door company about the security of your system and what you can do to better secure the remote system. Also check for technical issues that may cause your garage door to open randomly without your interaction.

Many residents have doorbell cameras for their front door. Perhaps consider adding a camera to the door going to your home from inside the garage.

HOA Security patrol reported 47 garage doors left open overnight in September and 43 in October. The community rules indicate your garage door should always be closed except for ingress and egress or when doing maintenance. This rule helps with aesthetics but is a very good rule to follow for the security of the home and safety of the occupants. Some residents prefer to leave their garage door open so have installed the approved roll down screen. This is a great solution, but the garage door should be down and secured in the evening or when leaving the home.

Residents should report crimes to the Lee County Sheriff's Department (non-emergency line) 239-477-1000 and then to HOA Office. For emergencies always call 911.

Home Sale Policy

This policy provides guidelines and rules and regulations for owners to provide notice to HOA of home sale listing, the permitted signs, specifications, placement and display criteria for the signs, and the days and times open houses are permitted.

The Home Sale Policy covers both those Herons Glen homes being sold by Owner or through a Real Estate Company. In both situations when a home is listed for sale the Homeowner (or their real estate agent on their behalf) will need to inform the HOA the home is for sale by completing a Home Sale Registration Form. The registration form is included in this policy and available online or in the HOA Office.

Rentals & Forms

All leases or rentals must comply with the governing documents, rules and restrictions for Herons Glen. The Sub Associations Fairways, Meadows, and Solana HOA’s may be more restrictive but not less restrictive than the governing documents of the Herons Glen Homeowners Association. Owners are responsible to confirm additional restrictions in their Sub HOA.

All leases or rentals shall be in writing and shall be for a minimum term of thirty days. Owners are required to provide renters with copies of the Covenants, By-laws and all rules and regulations pertaining to living in Herons Glen.

Units must be rented only in their entirety; no fraction or portion may be rented. There shall be no subleasing of units.

Renters are required to obtain copies of the above documents, whether supplied by the owner or not. These documents are available in the HOA Office.
All forms required by this policy, as well as a copy of the complete lease must be presented to the HOA Office at least 14 days prior to the rental date.

A copy of the completed Rental Information Form (Attachment 1) must be presented to the HOA office at least 14 days prior to the rental date. If the Rental Information Form is not received as required, the renter will not be permitted to enter Herons Glen until verification of the lease has been accomplished.

A signed acknowledgement by Renter (Attachment 3) stating they have read the rules and regulations (Attachment 2) must be presented to the HOA office on or before the day of arrival.
If the owner defaults with HOA assessments, the HOA shall have the right to collect all rental payments due to the owner and apply the same against unpaid assessments.

The association may levy reasonable fines up to $100 per day, up to $1000 per violation against any owner, or owner’s tenant, guest, or invitee for failure to comply with any provision of the Declaration, Bylaws, or reasonable rules of the HOA. (Per Florida Statutes)

Information on the extension of a lease must be supplied to the HOA office prior to the expiration of the original lease.

HOA Security, Safety and Emergency Preparedness Committee (SSEP Committee) Monthly Report

The following is a summary of topics discussed at the September 22, 2023, SSEP meeting. The meeting was held in Activity Room B.

The SSEP is sponsoring a free non-certified CPR/AED class on November 15, at 1 pm in the ballroom. North Fort Myers Fire Department will be instructing the class.

The SSEP will continue to send out safety briefs to educate the residents and bring awareness to the possible risks and hazards.

There was a discussion regarding golf carts, registration, insurance, and a waiver of liability.

The HOA Manager will obtain quotes for LED gate arms.

Craig Woolley and Karen Wills met with Officer Sam Flores from the LCSO to request equipment and ice cream for the upcoming Firewise Community Day Event on February 12, 2024.

A Frauds, Scams and Identity Theft program has been scheduled for December 7, 2023, at 1 pm in the HOA conference room.

Next meeting will be held on October 27, 2023, at 8:30am in the HOA Conference Room and via zoom.

Pet Rules and Regulations

To help ensure the safety of our residents, their pets and guests, in accordance with the Declaration of Covenants, Conditions and Restrictions for Herons Glen Article XIII,

Section 4 Animals and Pets and to clarify:

Article XIII, Section 4 of the Declaration

Animals and Pets. No animals, livestock, or poultry of any kind shall be raised, bred, or kept on any portion of the Properties, except that dogs, cats, or other usual and common household pets not to exceed a total of three (3) such pets may be permitted in a Unit. No pets are permitted to roam free.

If the owner fails to honor such rule, the pet may be removed, or a fine or other penalty may be imposed by the Board of Directors. No pets shall be kept, bred, or maintained for any commercial purpose. Household pets shall at all times whenever they are outside a Unit be confined on a leash held by a responsible person. Persons walking pets shall be responsible for removing solid pet waste and properly disposing of the waste.

1. No more than three pets are permitted in a Unit. Sub Association rules and regulations may be more restrictive but not less restrictive.
2. No pets are permitted to roam free outside of the Unit.
3. No pets shall be kept, bred, or maintained for any commercial purpose.
4. All pets whenever outside of a Unit must be confined on a leash that is held by and under the control of a responsible person.
5. Persons walking pets are responsible to remove pet waste and properly dispose of it at their Unit. Disposal of pet waste on Common Areas or locations other than the Lot Owner’s Unit is not permitted.
6. Pet owners are not permitted to allow their pets to create any noise or other condition that will or might disturb the peace, quiet, safety, comfort, or serenity of the occupants of surrounding property.

Sub Association rules and regulations may be more restrictive but not less restrictive. Residents and tenants living in a Sub Association are responsible to check their documents for additional restrictions.

Violations

1st Notice of Violation to the Lot Owner will be a warning.

2nd Notice of Violation to the Lot Owner will result in a $100.00 fine.

Additional violations will result in a $100.00 fine for each occurrence.

Violation of the Pet Rules & Regulations may result in additional action by the Association board and/or management as allowed by the governing documents of Herons Glen.

Delivered at the HOA Board Workshop October 3, 2023

The Finance Committee met on September 28, 2023.

The resurfacing of Herons Glen Blvd from the Rt 41 entrance to Via la Quinta is complete except for some punch list items and road striping. The total costs are within budget.
The HOA manager is soliciting additional bids for replacing the pavers at the Herons Glen entrance.

Most Hurricane costs are in. Road sign work still needs to be completed. There have been problems with the current road sign contractor keeping on schedule and poor workmanship.

The final Hurricane Ian cost estimate is still $300,000.

The common area sidewalk and valley gutter cleaning is completed.

A motion was made to suspend a resident’s barcode for access through the resident gate for Lot #505 & #315 for non-payment of HOA assessments. Entry will still be permitted through the visitor lane.

The next regular HOA Finance Committee meeting will be held on October 26, 2023 @ 1:30 in the HOA Conference Room.
Communications Committee Report

After the Meeting of September 20, 2023

All Committee Members were in attendance as well as Joyce Gillespie, HOA Manager, and Chris Kozak, HOA Board Liaison.

The July minutes were reviewed and approved.

Two new members were introduced and welcomed – Patti Cummings and Mary Kelley. Chris, Joyce, and Linda provided the new members with an overview of the Committee’s work.

The Herons Glen HOA and HGRD Governing Structures document is nearly ready for HOA Board review and approval. All Committee members, along with Chris and Joyce, will do a final proof of the document, with comments to Mike by 9/23 so Chris (and possibly Mike) can present the document at the upcoming HOA Board Workshop on 10/3.

There was discussion on including this document in New Resident Welcome Kits used by the Welcome Committee, as well as ways to make it available to all other residents. Linda will check with the Newspaper Team to see if it can be printed in the paper. An item in the Weekly Bulletin can also provide a link, and possibly copies can be made available at the HOA Office.

Mike reviewed the Grounds Committee Approval Processes flow document with all attendees. Grounds (Mary Wright and Sandra Dresch) has signed off on the document. All Committee members, along with Chris and Joyce, will do a final proof of the document, with comments to Mike by 9/23 so it can be presented at the upcoming HOA Board Workshop on 10/3.

Linda has invited Andrew Cohen of the Architectural Review Committee (ARC), and any ARC member of his choosing, to attend the October meeting so the Committee can share with him the work we have done with the Grounds Committee in the hope that we can be similarly of value to ARC. Mike will bring the documents he has prepared for ARC and will share them with the Committee before the next meeting.

Patti asked if Channel 902 is used for residents to view Board meetings. Joyce explained that HOA Board meetings are open only to residents, not the public. She then explained the process for residents to “zoom” attend Board meetings. Linda will take information about the process from a recent Weekly Newsletter and prepare a Newspaper article to be run (with Joyce’s approval).

The October meeting will be held on Wednesday October 18, 2023, at 1:00 pm in the HOA Conference Room.

President’s Report - October 2023

As many of you know, we will have an election this year for the two HOA Board seats expiring at the end of the year; there are three candidates running. We will have a Meet the Candidates night on Monday October 23rd, beginning at 5 pm in the Ballroom. I wanted to review the protocol for that evening as it was streamlined a couple of years ago. As previously, the candidates will be seated in front of the audience in alphabetical order, and each will have a microphone. The moderator will be stationed at the Podium, on the side so he/she can view both the candidates and the audience. Each candidate will give an opening statement, then the moderator will then ask each candidate to answer two standard questions. All of this will proceed in a rotating alphabetical order. Audience questions must be written and will be collected by the nominating committee, seated at the back of the Ballroom. If you have not prepared your question(s) prior to your arrival, paper and pencils will be available. Once all the questions have been accumulated, the nominating committee will consolidate the questions and present them to the moderator, who will address the candidates. I encourage each of you to attend the Meet the Candidates night on October 23rd; these are important positions affecting your community.

In other notes, collections have started for our new fiscal year, which began October 1st. Our committees also started their new one-year terms that same date. Per our contract with Blue Stream, the base internet speed has been increased from 300/300Mbps to 400/400 in the third year of our contract.
