Pet Rules and Regulations

To help ensure the safety of our residents, their pets and guests, in accordance with the Declaration of Covenants, Conditions and Restrictions for Herons Glen Article XIII, Section 4 Animals and Pets and to clarify:
Article XIII, Section 4 of the Declaration
Animals and Pets. No animals, livestock, or poultry of any kind shall be raised, bred, or kept on any portion of the Properties, except that dogs, cats, or other usual and common household pets not to exceed a total of three (3) such pets may be permitted in a Unit. No pets are permitted to roam free.
If the owner fails to honor such rule, the pet may be removed or a fine or other penalty may be imposed by the Board of Directors. No pets shall be kept, bred, or maintained for any commercial purpose. Household pets shall at all times whenever they are outside a Unit be confined on a leash held by a responsible person. Persons walking pets shall be responsible for removing solid pet waste and properly disposing of the waste.

1. No more than three pets are permitted in a Unit. Sub Association rules and regulations may be more restrictive but not less restrictive.
2. No pets are permitted to roam free outside of the Unit.
3. No pets shall be kept, bred, or maintained for any commercial purpose.
4. All pets whenever outside of a Unit must be confined on a leash that is held by and under the control of a responsible person.
5. Persons walking pets are responsible to remove pet waste and properly dispose of it at their Unit. Disposal of pet waste on Common Areas or locations other than the Lot Owner’s Unit is not permitted.
6. Pet owners are not permitted to allow their pets to create any noise or other condition that will or might disturb the peace, quiet, safety, comfort, or serenity of the occupants of surrounding property.
7. Sub Association rules and regulations may be more restrictive but not less restrictive. Residents and tenants living in a Sub Association are responsible to check their documents for additional restrictions.

Violations
Notice of Violation to the Lot Owner will be a warning.
Notice of Violation to the Lot Owner will result in a $100.00 fine.
Additional violations will result in a $100.00 fine for each occurrence.
Violation of the Pet Rules & Regulations may result in additional action by the Association board and/or management as allowed by the governing documents of Herons Glen.
Parking and Vehicle Rules & Regulations

To help ensure the safety of our residents and guests, in addition to the vehicle restrictions in Article XIII, Section 2 of the Declaration, the use of private vehicles on Association property, and the roads of Herons Glen, requires compliance with the following rules.

Automobiles:
1. Owner or occupants residing in a Unit must register their vehicles with the Association office.
2. An automatic gate barcode may be attached to the driver's side of the vehicle.
3. No more than two vehicles shall be parked in driveway serving any unit on a regular basis. A car shall be deemed parked on a "regular basis" if parked in such driveway more than seventy-two hours in any seven-day period without prior approval of the Board of Directors.
4. Commercial vehicles, vehicles with commercial writing on their exteriors, vehicles primarily used or designed for commercial purposes are not permitted to be parked in the driveway.
5. Mobile homes, trailers (either with or without wheels), campers, camper trailers, motor homes, recreational vehicles, ATVs, boats and other watercraft, and boat trailers are not permitted to be parked in the driveway.

Privately Owned Carts:
1. Owner or occupants residing in a Unit with private carts must register with the Herons Glen Recreational District (“HGRD”) through its established procedures.
2. Private carts must be electrically powered and equipped with headlights and taillights or reflectors if used after dusk.
3. Private carts must meet Safety Standards (ANSI-Z130-1-2020). These standards are available for review in the Association office or by clicking on the following link: ANSI-Z130-1-2020
4. Each operator of a private cart must be at least 18 years old or have a valid driver's license.
5. This section is not applicable to service vehicles operated by the HGRD and/or Association.

All vehicles including automobiles, carts, mopeds, bicycles, motorcycles, RV's or other mode of transport:

Owners or occupants residing in the Unit will be held fully responsible for any and all damages caused by the Owner/occupant or their negligence, or by that of their family or guests. The costs resulting from any and all such damages, including legal fees incurred by the Association, will be charged to the Owner’s Lot as a User Assessment under Article XI of the Declaration.
1. All must obey traffic signs and/or other posted traffic and parking instructions.
2. All vehicles must use caution when in the area of other vehicles or pedestrians.
3. No vehicles may be stored or left overnight on any Common Areas, including streets. (See the Security Policy for exceptions to this rule for RVs, Enclosed Trailers and Boat Trailers.)
4. No stored vehicles are permitted on any lot without the prior approval of the Board of Directors. (See Article XIII Section 2 paragraph (a) of the Covenants.)

Violations:

Parking violations
Parking citations will be issued by the Herons Glen HOA Roving Patrol Officer. Citation will be placed on the vehicle. A copy of the citation will be provided to the HOA Office.
1. 1st citation issued for street parking will be a warning to the Lot Owner.
2. 2nd citation issued for street parking will result in a $25.00 fine to the Lot Owner.
3. Additional citations for street parking will result in a $25.00 fine to the Lot Owner each time a citation is issued.

Violation of the Parking and Vehicle Rules & Regulations may result in additional action by the Association board and/or management as allowed by the governing documents of Herons Glen. Further, vehicles in violation of the Governing Documents may be towed or booted by the Association at the Owner’s expense. No notice is required prior to towing or booting other than the existence of appropriate signage as may be required by Florida Statutes.

The posted speed limit for residential streets is 16 mph and 26 mph on Herons Glen Blvd.

Grounds Approval Requests

Before starting your landscaping project, installing a fountain or a flagpole please submit the required approval request form and support documents to the HOA Office by March 2nd before 2:00 pm for review at the March 9th Grounds Meeting.

Please review the Grounds Community Wide Landscape Standards before starting any work on your landscaping or related items. A copy of the standards is available on the table outside of the HOA Office, on the HOA Website at

Before submitting a Grounds Committee Approval Request Form- plan your project ahead of time, get the necessary information to describe the work you are planning, name of company doing the work, licenses, and insurance.

Choose a landscape company that has a Lee County Business Tax License, General Liability and Workers Comp or Workers Comp Exemption. Your request will not be reviewed until the items are provided. Herons Glen does not have a list of approved contractors.

Grounds Requests and the required documentation must be submitted by the Thursday prior to the scheduled meeting. Work cannot be started until the request is reviewed and approved by the Grounds Committee. The requests are approved at the Grounds Committee meeting by vote of committee members.

It is a violation to start a project without first receiving approval from the Grounds Committee

The Grounds Committee met on January 12, 2023.

Inspections have been renewed following a moratorium due to Hurricane Ian.

President’s Report - February 2023

As I am writing this report, the SSEP Committee is wrapping up our annual Firewise Event, complete with food, drink and numerous important displays and interaction from community first responders and others. This event also serves as an opportunity for all of us to contribute to retired first responders. The Activities Committee conducted the bulk shredding event which gives all of us the opportunity to clear out some unneeded paperwork and hopefully provide another chance to make a charitable donation. This year’s event also included a Bloodmobile drive. I hope everyone has a chance to participate in some or all of these worthy events.

Earlier this month the Activities Committee sponsored an Activities Fair in the Ballroom; yet another opportunity to discover or reconnect with the variety of activities our community has to offer. The Activities Committee is also sponsoring a “Stuff the Truck” Event on March 4th to support Hope Hospice.

As many of you probably heard, we had a serious accident when a sedan ran under a parked trailer being used by a roofer to disposed of the old roof tear down materials. It is fortunate that no one was injured, but for those who have seen photographs of the car, this could have resulted in serious injury or even a fatality. There were several factors contributing to this severe accident and an investigation is underway. It does however, remind us that we all must be vigilant of safety within and outside of Herons Glen. Safety within our community begins with observing all stop signs and posted speed limits, but also includes always being an alert and observant driver. Although our SSEP Committee is always seeking ways to improve the safety of Herons Glen, it is up to each of us to do everything we can to ensure our own safety.

I would also like to thank all who are and have taken steps to improve and beautify their property. We are still recovering from the impact or Ian, but it is nice to see the efforts being made to make Herons Glen such a nice place to live.
