Garage Doors

The Declaration of Covenants, Conditions and Restrictions of Herons Glen Homeowners Association Article XIII, Section 2… requires that garage doors and/or roll down screens shall remain closed at all times except during ingress, egress, occupancy of the garage or during lot maintenance by the homeowner.

An unattended open garage is inviting to wildlife, snakes, and rats, and it provides easy access for criminals.

Do not leave your garage door open without the garage screen rolled down and remember to close and secure your garage door at night.

Garbage Can Storage

It has been noticed that residents are storing garbage cans and other items outside their unit and not completely screened by landscaping. Article XIII Section 8 addresses the storage of all such items. Please read this part of the Declaration of Covenants, Restrictions and Conditions so that you may be sure you are not in violation of this restriction. The middle of your driveway or placed to the side of your unit with no landscaping to completely screen the item is not the proper way to store such items. Improper storage may also fall under the restrictions noted in Article XIII Section 6.

The HOA wishes to thank all the residents who continue to keep the community attractive by complying with the standards.

Flagpoles, Flag and Banner Guidelines
Flags and Banners

In accordance with Florida Statute 720.304(2) (a) homeowners may at any time display one United States flag in a respectful manner from a house mounted flag holder or an approved flagpole. In addition to the United States Flag flown per Florida Statute 720.304 (2) (b) one official State of Florida or one official flag representing the United States Army, Navy, Air Force, Marines or Coast Guard or a POW-MIA flag may be displayed, so long as the one flag is displayed in a respectful manner and so long as the one flag is equal in size to or smaller than the United States flag, which may not be larger than 41/2 feet by 6 feet.

Unless otherwise permitted by law, the United States flag, the Florida flag and all U.S. Military flags must be displayed in accordance with Section 6a of the Flag Code which states that it is the universal custom to display the United States flag from sunrise to sunset only on buildings or stationary flagstaffs in the open. However, when a patriotic effect is desired, the flag may be displayed 24 hours a day if properly illuminated during the hours of darkness. Permitted flags and banners, regardless of type, should remain serviceable, and not be faded or tattered.

If a resident chooses not to display a United States, Florida or U.S. Military flag, then a single flag or banner pertaining to a holiday may be displayed from a house mounted flag holder or approved flag pole, but only for a period not to exceed seven (7) days during the time of the holiday. Special event (e.g. sports games, birthday and anniversary) flags or banners are permitted for that day only. Notwithstanding the above, Christmas flags or banners may be displayed starting from the Monday before Thanksgiving to January 10 each year.

Guidelines for the Installation and Use of Flagpoles
A resident may erect a freestanding flagpole. Submit a request to the Grounds Committee for their review addressing all of the requirements listed below, include a schematic and desired location of the flagpole. The flagpole should not be installed until the Grounds Committee has reviewed the request.

The maximum height of a flagpole can be no more than 20 feet.

The flagpole must be the telescoping design and constructed of a minimum 16-gauge aluminum. It must be of aluminum color or white.

The sleeve which holds the flagpole must be set in a concrete base no larger than 15 inches in diameter but not less than 12 inches, and no less than 18 inches underground.

The concrete base must be encircled with plantings extending not less than 2 feet in diameter, and a small area of mulch or border outside the plantings must be installed, so it does not interfere with the lawn mowing and trimming.

The flag can be no larger than 4 ½ feet by 6 feet (per Florida Statute 720.304(2) (b). In addition to the U.S. Flag, the HOA Flags and Banner Guidelines must be followed.

The United States Flag, a Military flag and/or a POW flag must remain serviceable, and not be faded or tattered.

The Flag must be flown at all times.

When severe weather is forecast, and/or a resident will be away from their home for an extended period of time, seven days or more, the Flag(s) must be taken down and the flagpole fully retracted.

The flag must be illuminated at night. If the flag is not illuminated, it must be taken down and raised the following morning. The lighting in no way can infringe or invade upon the neighbor’s privacy.

If a resident no long wishes to fly the U.S. Flag on a flagpole or the home is sold and the new resident does not wish to fly a U.S. Flag the flagpole then must be removed.
