Residents who are not on Automatic Payments should consider signing up for auto pay or set up bill pay through your bank. This is the most secure way to make assessment payments.

Remember that bill pay through your bank takes extra time to arrive so please set the payment date early to avoid late fees.

Paying by mail can also take extra time for delivery but still must arrive by January 15th so please mail early to avoid the late and interest fees.

If you receive electronic statements through email and do not find that you received a statement by January 1st you are still responsible to pay the assessment fee on time. Check your spam and if still not there then send an email to bookkeeping@mbcopa.com. You will need to include your name, address and account number in the email.

Monthly Report
Meeting of December 14th, 2023

The HOA Activities Committee met on Thursday December 14th, 2023. Meeting called to order by HOA Board Liaison Denise Fell at 10:00 AM. In attendance: Bernadette Schirra, Debbie DeFazio, Shirley Hrabar, Suzanne Offutt, Joyce Lipkin. Janet Norris was not in attendance and Donna Piascik had an excused absence.

Old Business

1. The Christmas Cart Parade was held on Sunday December 3, 2023, and was a huge success. Twenty-four carts were in the parade lead by the Marching Gator Band from Island Coast High School followed by Santa and Mrs. Claus. The generous residents of Herons Glen donated $1550.00 to the band during the parade which will be used to purchase multiple new instruments.

New Business

1. Holiday decorating is scheduled to be taken down on Monday January 8th starting at 9:00 a.m.

2. The Activities Fair is scheduled for Sunday, January 21, 2024. 30 groups are registered for the event.

3. Shredding Event – During the Firewise event on Monday February 12, 2024, from 10-11:30 a.m. the Iron Mountain shredding truck will be at Herons Glen.

4. Technology Class – A computer class for Seniors is scheduled for February 20,2024. A sign- up sheet is available outside the HOA office. Class size will be limited to 35.

5. The Ice Cream Social will be replaced by a Dog Show Event on Sunday, April 14, 2024. More information will be forthcoming.

6. We are coordinating an event with the Peace River Wildlife Center. More information is forthcoming.

Next meeting to be held on Thursday January 18th, 2024, at 10:00 AM in the HOA Conference Room.

The end of 2022 was certainly a Grounds Committee challenge due to the destructive Hurricane Ian. No Grounds inspections were done during the months of September through December. This allowed residents and Committee Members to focus on the cleanup aftermath of the Cat 5 storm. Both fulltime and seasonal residents are commended for a quick cleanup of downed trees and shrubs.

The Grounds Committee allowed residents to remove their yard waste without going through prior approval but asked for applications afterwards to document what shrubbery was removed and replaced which resulted in 36 applications for just the months of January and February. This kept our committee members busy visiting residents with the approval process. There was a total of 136 ground applications last year. The Committee also continued to monitor yard and garbage waste that is put out on the street before 6 pm the night before pickup. For the year we had 77 infractions.

Other challenges the Grounds Committee faced and are still facing are CLIS system issues and the number of new, seasonal, and rental property owners who are not aware of the Grounds application process or Landscape Standards. It’s a continual learning and training process for both residents and Committee Members.

I’m proud to say we have a good Grounds Committee which consists of eight people covering four zones or 1300 homes. Two of the members are new this year; four members have between 2-3 years’ experience while two have OVER five years of experience! There is one alternate member who steps in when needed to help assist with inspections plus she serves as our Secretary. Another zone member serves in a dual capacity as a Co-Chairperson. A few things this Committee does not lack is tenacity & initiative to get the job done and LACK of work!

The Grounds Committee would also like to thank Joyce Gillespie and staff for their support and continual hard work with assisting us with backup documentation on residents’ requests and citations. The HOA office serves as a sounding board plus keeps us on track within Herons Glen guidelines.

Lastly, we want to recognize YOU, our residents in supporting our common goal in keeping Herons Glen a beautiful community. Plans are to resume the Outstanding Landscaping Award in 2024. Two residents will be recognized: one in the spring and one in the fall from different zones. This recognition is for residents who have maintained their yard according to Herons Glen standards.

And to each of you, we cherish your kind comments. One of the most heartwarming and biggest benefit our committee members receive from you is THANK YOU for our time and commitment! It helps maintain our morale and attitude while doing this volunteer job.

Before I begin, I’d like to express my deepest gratitude to Craig Woolley (SSEP Chair) for all his help and advice throughout the year.

Additionally, I’d like to thank the HOA Board, Joyce Gillespie, and her staff for all their support to help us make CERT happen, because without their support, it simply does not.

Included in this report are just a few things CERT was involved in throughout the year:

Along with being involved with some of the things SSEP did, CERT was also activated twice this past year on account of tropical events. I wish to report that with the help of our CERT Captains we were able to successfully utilize our team radios with the newly located antenna flawlessly. And, thankfully we as a community encountered zero storm related events needing CERT attention, but we were at the ready.

This past year CERT also participated in our Herons Glen activities Fair and were able to raise awareness to what it is we do for our community. Because of this event CERT was able to help additional residents sign up to join CERT, and we continue to help as many of those residents become FEMA certified as we can. Some have already become certified.

I continue to attend FEMA sponsored CERT leaderships meetings for additional training opportunities that are available. We also share information with other local CERT communities.
Our residents CERT commitment to the safety of our community continues simply because of our many residents’ participation, and for that I wish to thank each and every one of them.

Year End Report

First and foremost, I would like to thank the HOA Board members for their continued support along with Joyce Gillespie and her staff.

Below is a list of items the SSEP has accomplished for the year ending 2023.

As a committee, SSEP continues to be open to suggestions from homeowners and encourages residents to continue expressing their ideas and to know that their suggestions will be thoughtfully and kindly considered.

Accomplishments:

1. Firewise community day 2023 raised a little over around $9,000.00 for the fallen firefighters of SWFL. The Firewise check presentation was held on 2/13/23 in the Herons Glen Ballroom. The donation of funds was disturbed to the firefighters Local 1826 of Fort Myers, the Leroy Nottingham foundation.
2. The SSEP Firewise committee has set the date for its annual Firewise event which will be held on 2/12/24.
3. The SSEP worked with the NFMFD and LCEMS on a LZ for the Helicopter, this location is on North Mystic. To date there has been 3 Helicopter landings.
4. The SSEP and LCSO put together a Car fit program that was to be held on March 7, unfortunately it was cancelled.
5. SSEP, HOA and LCSO worked together on having a camera installed at the guard house.
6. The SSEP worked with the HGRD on having Golf rangers posted at Herons Glen Blvd. and Palo Duro for shot gun starts. This was for safety concerns.
7. The SSEP’s subcommittee CERT was activated twice this year, both for tropical storms.
8. SSEP worked with the HOA to have a standby generator installed at the guard house and had the radio antenna relocated to the front gate.
9. The SSEP continues to review all damaged Sidewalk and Curbing and reports their findings to the HOA.
10. The SSEP committee along with LCSO sponsored a READY class this past year that was well attended.
11. The SSEP and NFMFD the scheduled CPR/AED class on November 15th was cancelled due to illness. Another class will be scheduled soon.
12. The SSEP and LCSO held a Fraud Seminar on December 7th.
13. The HOA has directed the SSEP to investigate Golf cart safety and regulations. At our Oct meeting the SSEP formed a subcommittee to research and report their findings back to the HOA.
14. Firewise 2023/2024 renewal has been received and will be submitted for approval to the NFPA.
15. SSEP will provide traffic control for the Christmas cart parade.

• 18 years of publication we have not missed publishing an issue. That is 216 months of work that have resulted in a newspaper to your home each month (this includes one online edition our staff produced themselves when Seabreeze shutdown during the COVID pandemic)

• Thank you to Anita Sharninghouse for her years of service coordinating the newspaper

• The newspaper committee consists of two groups

o Production team – Karen Jessop, Linda Lynch, Pam Sheid, Jack Nelson, Kathleen Lynch; plus, our HOA liaison, Chris Kozak

o Delivery Coordinators – Rick and Pat Scharf (formerly Dominic Polidoro); plus, their many volunteers who deliver to your door

• Our production team writes, edits and coordinates everything prior to submitting the articles/photos to Seabreeze Publications for publishing the hard copy of the paper at no cost to our residents.

• The production team meets once a month to plan the upcoming newspaper. During this meeting we discuss potential articles and placement in the newspaper. Numerous residents submit articles and photos that usually include our many social groups as well as activity and sporting events. Plus, included in every issue are two articles the staff deemed helpful to our residents:

o VOG Ride Share

o Official HG Sources of Information

• Our delivery coordinator, Dominic Polidoro, did an excellent job, but after six months had to relocate out of state. We were very fortunate that Rick and Pat Scharf returned in June to lead the Delivery Team of 45+ volunteers once again. These dedicated volunteers deliver the paper to the 1300 homes in Herons Glen. They continue to complete this task professionally and successfully.
The online copy of The Heron is available to all residents. It can be found on the HOA website.

• Challenges overcome this year included illness, injury, retirement, and loss of volunteers. The dedication of all our members and the enthusiasm they show each month is amazing! If anyone would like to join us in working on The Heron, our contact information is printed in each issue.

We thank the HOA Board of Directors for their support and the many Herons Glen residents who have worked with our teams to assure enjoyable and informative articles are included in each issue of The Heron. This is your newspaper so we welcome your feedback and ideas.

After the HOA Board approved the new guidance for the Communications Committee, we worked to fill our vacancies, a task now completed.

A Government Structures document for the Herons Glen HOA and HGRD was prepared and reviewed by the Committee and Manager Gillespie. The HGRD is finalizing their comments on the document. Once changes are finalized and reviewed by the Committee, it will be submitted to the HOA Board for approval and distribution.

A flowchart document visualizing the Grounds Committee Request & Approval Processes was prepared and approved by the HOA Board in November.

A similar flowchart document visualizing the Architectural Review Committee Approval Process was prepared and will be reviewed by ARC one more time; when finalized by the Committee, it will be sent to the HOA Board for approval.

Pet Rules and Regulations

To help ensure the safety of our residents, their pets and guests, in accordance with the Declaration of Covenants, Conditions and Restrictions for Herons Glen Article XIII, Section 4 Animals and Pets and to clarify:

Article XIII, Section 4 of the Declaration

Animals and Pets. No animals, livestock, or poultry of any kind shall be raised, bred, or kept on any portion of the Properties, except that dogs, cats, or other usual and common household pets not to exceed a total of three (3) such pets may be permitted in a Unit. No pets are permitted to roam free.
If the owner fails to honor such rule, the pet may be removed or a fine or other penalty may be imposed by the Board of Directors. No pets shall be kept, bred, or maintained for any commercial purpose. Household pets shall at all times whenever they are outside a Unit be confined on a leash held by a responsible person. Persons walking pets shall be responsible for removing solid pet waste and properly disposing of the waste.

1. No more than three pets are permitted in a Unit. Sub Association rules and regulations may be more restrictive but not less restrictive.
2. No pets are permitted to roam free outside of the Unit.
3. No pets shall be kept, bred, or maintained for any commercial purpose.
4. All pets whenever outside of a Unit must be confined on a leash that is held by and under the control of a responsible person.
5. Persons walking pets are responsible to remove pet waste and properly dispose of it at their Unit. Disposal of pet waste on Common Areas or locations other than the Lot Owner’s Unit is not permitted.
6. Pet owners are not permitted to allow their pets to create any noise or other condition that will or might disturb the peace, quiet, safety, comfort, or serenity of the occupants of surrounding property.
Sub Association rules and regulations may be more restrictive but not less restrictive. Residents and tenants living in a Sub Association are responsible to check their documents for additional restrictions.

Violations

Notice of Violation to the Lot Owner will be a warning.

Notice of Violation to the Lot Owner will result in a $100.00 fine.

Additional violations will result in a $100.00 fine for each occurrence.

Violation of the Pet Rules & Regulations may result in additional action by the Association board and/or management as allowed by the governing documents of Herons Glen.

Pools, Lanais and Screening

The ARC has found that there are still homes with damage from Hurricane Ian that have been missing lanais or pool enclosures and some with missing screening. In the coming months, notices will be issued to owners who have not submitted an ARC application. The application must include drawings and details for replacement and name of the contractor.

In addition, any residence with a pool that does not have their pool screen enclosure replaced yet must have a temporary construction safety barrier installed by their contractor. Contact Lee County Community Development for questions concerning pool safety requirements.

The Design and Development Guidelines require pools to have a screen enclosure.

Pools:
In ground pools and spas are permitted. The pool or spa must be inside of a screened structure attached to the home. The screened structure cannot be higher than the existing home.

• Pools shall be of the in-ground type. Above-ground pools are prohibited. The elevation at the top of the pool shall not be over two feet (2′) above the natural grade of the lot.

• Pool and/or spa must be installed in-ground with a concrete or paver deck and enclosed with screened aluminum framing.

The Architectural Review Committee reviewed 50 applications for the remainder of 2022 in addition to the 481 from January 2023 to December 2023. Many roof and cage replacements have been submitted and reviewed since Hurricane Ian.

The ARC reviewed and updated the ARC application for clarity with the inclusion of solar for electric and water heating including solar tubes.

Additionally, the Architectural Review Committee introduced another roof material to the roof tile selection. The approved material is a composite material with many colors emulating the traditional barrel roof profile.

The communications committee reached out to the ARC to maximize the submission and review process for the residents better understanding.

I would like to thank our previous and new members of the ARC for their endless hours of contributions to the committee and while Hurricane Ian was a challenge the committee continued to review applications for emergency repairs.

We feel our neighborhoods could not be as beautiful as it is without our dedicated volunteers.

Unfortunately, Kathy Petrillo could not be with us this afternoon, but it gives me the opportunity to thank her and her team of Patricia Amico, Kathy Barringer, Andy Edmunds, James Fitzgerald, Karlyn Gies and Steve Simpson for all their hard work in making our new Residents feel welcome in this wonderful community.

The primary goal of this committee is to contact all new homeowners & provide a 1:1 Meet & Greet with one of our committee members who provides them with information to help them navigate through our piece of Paradise.

From 1/1- to 12/1/2023:
51 new closings (15 prior residents). To date, 50% of new homeowners have had a 1:1 Meet & Greet with a committee member; 10 new homeowners are pending, as just returned to community or not ready for a meeting. The remainder have not responded or chose not to be greeted. Overall, there has been an increase in contacts over the past year with the committee's cooperation and dedication.

A new handout will be provided soon in the welcoming packet, HERONS GLEN COMMUNITY GOVERNING & OVERSIGHT STRUCTURE, developed by the Communications Committee. This provides a very detailed flow chart of responsibilities of HOA & HGRD, as sometimes confusing to new homeowners.

The committee provides 3 group socials in season in the private dining room, so newcomers can meet other newcomers. The Residents are also provided updated communications from HOA & HGRD. At these group socials each homeowner introduces themselves and tells everyone why they purchased in HG. The committee members are also provided with a tour of the clubhouse, if desired. These socials are very well received and have contributed to the start of many new friendships.

Bingo starts the first Tuesday in September and ends the last Tuesday in May, for a total of 39 weeks. Doors open at 6 p.m. and bingo starts at 7 p.m.

Bingo season 2022/2023 we played bingo only 36 out of the 39 weeks. Two weeks we were closed because of hurricane Ian and one week the ballroom was booked with an outside event. During those 36 weeks attendance was 7303. Previous season 2021/2022 total attendance was 6501 for the 39 weeks. January 31, 2023, we recorded our largest attendance 276.

The first 13 weeks of 2023/2024 our attendance is 2287.

The Activities Committee would like to give a huge THANK YOU to Pat Stuchly who chaired this committee for many years. Endless hours go into creating, preparing for, and carrying out these events. Thank you, Pat, for all your hard work and dedication.
Also, a BIG Thank you to Joyce Gillespie, Kim Rambo, Lori Roy, and Jeremiah Radel our HOA office team. Without their assistance, guidance, mad copying skills and Can-Do attitude we would not be able to host all these wonderful events for our Residents.

Members of the Activities Committee for this new year from October 1, 2023, through September 30, 2024, include Bernadette Schirra, Secretary; Sue McCoy, Treasurer; Debbie DeFazio, Shirley Hrabar, Joyce Lipkin, Suzanne Offutt, and Donna Piascik; alternate Janet Norris; and Chairman and HOA Board liaison Denise Fell.

Activities/events hosted by the Activities Committee for 2023 were:

• We kicked off the new year with our Activities Fair on February 5, 2023. This event is always a great opportunity for our Residents to learn about the full complement of classes, clubs, organizations, and activities within the Herons Glen community. Representatives from 25 of our groups were scattered throughout the Ballroom sharing their love and knowledge of their specific group/activity and in many cases recruiting new members.

• With identity theft a major concern along with the want to protect mother nature, the annual Shredding Event is always well-attended by our Residents and this year was no exception. This year’s event was held on , in cooperation with the HOA SSEP Committee Firewise Day.
• On March 4, 2023, we Stuffed the Truck for Hope Hospice. Herons Glen Residents once again showed their generosity by filling a large truck full of donations such as clothes, small appliances, bedding, tools and much, much more for Hope Hospice.

• Herons Glen Residents sure do love Ice Cream. The annual Ice Cream Social was held April 16, 2023, in the Ballroom.Ice cream sundaes garnished with hot fudge, strawberries, nuts, whipped cream and topped with a cherry were served to the residents thanks to the Committee members and additional volunteers. Music was provided by Paul Lowe and Tom Foster.

• On April 19, 2023, the committee offered a Cybersecurity class for Seniors. The Speaker offered great suggestions around picking safer passwords among other great tips to keep our Residents’ information protected. The class was well attended, and participants felt they learned valuable lessons. The Committee will be offering a similar class in 2024.

• On November 20, 2023, members of the Committee, along with several residents, volunteered their time and skills to “Lite up the Glen”. Between climbing trees, stringing lights, putting together displays, hanging wreaths, and fighting with the electrical cords, all the Volunteers played a critical part in creating a beautiful Holiday entrance for our Residents, Friends, and Families.

• The 6th annual Christmas Golf Cart Parade was held on Sunday, December 3, 2023. The Marching Gator Band from Island Coast High School led truly fantastic, decorated golf carts along with Santa and Mrs. Claus through the Historic District of Herons Glen. Always a highly anticipated, well attended, holiday event.

The Finance Committee had a productive year. Our committee members: Bill Beadle, Pat Colucci, Bill Dawes, Dennis Deluca, James Ingersoll, Cathy Styles and John Trimble deserve a big thank you from the entire community for their dedication and hard work. Welcome Susan Darcy and Sherry Long to the Finance Committee. Thanks to Bill Beadle for taking minutes at all our meetings.

The committee oversaw and completed several projects in 2023:

The Platinum Security Group, in their second year of service, continue to provide efficient and effective security to the Herons Glen Community.

Blue Stream continues to provide very good tv and internet service at a reasonable cost.
Herons Glen Blvd was repaved from the front gate entrance to Via La Quinta. This included repair of damaged curbs and valley gutters.

Hurricane costs for the HOA were about $250,000.

The damage and length of the electrical outage at Herons Glen was unprecedented. Because of this we have installed a propane gas fed generator at the guardhouse. This will allow the operation of the gate system and the internet to continue functioning until the power is restored. The repeater and antennae for the emergency walkie talkies was moved from the clubhouse to the guardhouse to operate off the generator in the event of power outage. Security for Herons Glen has been improved.

Substantial amounts of our liquid capital continue to be placed into CD and Money Market accounts from banks giving the best returns.

The Finance Committee recommends projects and budgets to the HOA board, which has the final decision.

Every year the committee members propose an Operating Budget as well as a Revised Long-Range Plan for the Pooled Reserve Fund to the Board. The total HOA assessment is based on the total monetary requirements of these two budgets.

The major project this year was the Herons Glen Blvd work. Our Long-range plan anticipated that the cost of this project would be about $450,000, The actual cost was $698,000. The inflated cost of oil, a major component of asphalt, caused a dramatic increase in the cost of road work. Additionally, Hurricane Ian costs, which come from the Pooled Reserve Fund were about $250,000. We have not raised the annual monetary component to the Pooled Reserve Fund, which is the basis of the Long-Range Plan for the last eleven years.

In order to keep the Long-Range Plan realistic, we raised the Pooled Reserve component of the assessment by $50,000 per year. Inflationary costs and the Herons Glen Blvd project resulted in an 8.7% increase in the HOA assessment last year. The average HOA assessment has averaged about 3% for the last 15 years.

The committee budgets conservatively, and carefully, bearing in mind the realities of maintaining Herons Glen in the condition expected by its residents.

Delinquencies continue to be minimal, thanks to the efforts of our committee and our manager. We will continue to work with our attorney investigating all avenues available to us in the coming year to keep delinquencies to a minimum.

In addition to the issues, I have addressed above, the committee members make a complete review of the financials each month. The members review all delinquencies and determine if any additional actions may be warranted.

In closing, we have had a very successful year. These accomplishments could not have happened with-out the dedication of the committee members, our Manager, Joyce Gillespie, Kim Rambo, our assistant Manager and Lori Roy, our office assistant. They all have made my responsibilities much easier. Thank you all so much.

President’s Report Annual Membership Meeting 2023

We are wrapping up our year with our Annual HOA meeting, which will include annual reports from each of our committees. We also have arranged for speakers we feel will be of interest to our residents. As you are probably aware, various requests have been published asking for proxies for the annual meeting. Under Florida statues, HOAs are required to have an annual meeting each year with a minimum of 30% of the owners in attendance. We must verify the legitimacy of each owner and count only one per parcel. If we did this at the meeting it would require an inordinate amount of time to verify each owner’s identity and lot number. Getting the proxies submitted in advance streamlines this process, assuming we get the required minimum, so we can proceed with an orderly annual meeting, that hopefully residents will find informative.

We began our year with a number of events sponsored by various HOA Committees. This included an Activities Fair, Firewise event which also included the shredding truck. The Activities Committee sponsored the Activities Fair as well as the shredding while Firewise is sponsored by SSEP. The Activities Committee also sponsored the Ice Cream Social and decorates our front entrance during the Christmas season. The SSEP was instrumental in installing a back-up generator at the guardhouse and relocating the repeater antenna to that location to provide more reliable operation during a power outage. In conjunction with the HGRD, the Volunteer Appreciation Reception was held in April. Our HOA staff, along with the Board wishes to thank all of our volunteers that have served throughout the year. Fifty-one homes have closed in Herons Glen year to date.

I’m sure most of you have seen the repaving of the front half of Herons Glen Boulevard which also included replacement of the valley gutters along that section of the Boulevard as needed. The sidewalks were also cleaned this year. The HOA continues to work on many of our street signs that were damaged during Ian. Per our Blue Stream contract, our internet speed was increased this year; one more increase is built into that contract. All of this has been accomplished while maintaining an average increase in the HOA quarterly assessments of 3% over the long term.

Our Communication’s Committee is being completely revamped to provide improved service to our community.

The Board revised the Dennisport Gate Policy and the Home Sale Policy. ARC has also been very active this year developing and recommending revisions to our Design & Development Guidelines and Constructions Standards, while Grounds revised the Flag and Flagpole Guidelines to conform to the revisions in the Florida Statutes.

Herons Glen HOA Board Election Results

The Herons Glen Homeowners Association annual membership meeting was held on December 13, 2023. The 30% membership quorum was confirmed with 465 proxies received. Approximately 61 residents attended the meeting.

The Nominating Chair, Russell Long provided the election results at the meeting:

Chris Kozak- 497
Richard Romine- 486
John Sullivan- 159

The two candidates receiving the highest number of votes Chris Kozak and Richard Romine are elected to serve a three-year term beginning January 1, 2024 through December 31, 2026.

The Herons Glen HOA Board of Directors wishes to thank the candidates for their time and interest in the community.
